These Terms of Service (“Terms”) govern all services provided by Simon Migaj Studio (“we”, “us”, “our”) including architectural visualisation, photography, and any related creative work. By commissioning our services or using our website, you agree to these Terms.

We provide architectural visualisation and photography services for commercial and private clients.
Simon Migaj Studio is the Data Controller for the personal data we collect.

2. Scope of Services

We provide:

  • Architectural visualisation (3D rendering, CGI imagery, animations)

  • Interior and architectural photography

  • Image editing, retouching, and post-production

  • Delivery of final files in the format agreed in your proposal or quote

The specific details, deliverables, deadlines, and fees for each project will be outlined in a written proposal, estimate or email confirmation (“Project Agreement”).

3. Fees & Payment

3.1 Deposit

A 50% non-refundable deposit is required to secure a project or booking date. Work will not begin until the deposit is received.

3.2 Final Payment

The remaining 50% is due on delivery of the final approved deliverables unless otherwise agreed in writing.

3.3 Additional Costs

You may be charged separately for:

  • Travel expenses

  • Assistants, models or studio hire

  • Additional lighting or equipment

  • Extra revisions (see Section 7)

  • Changes to the brief after work has begun

Any such costs will be discussed with you in advance wherever possible.

3.4 Late Payment

We reserve the right to:

  • Withhold deliverables until payment is made

  • Charge interest on overdue invoices at the statutory rate

4. Client Responsibilities

You agree to:

  • Provide accurate and complete project information

  • Supply necessary references, drawings, brand guidelines, or access to locations

  • Ensure your premises or site is safe for photography

  • Obtain permissions for any individuals or property photographed or modelled

We are not responsible for delays caused by missing information or access issues.

5. Project Changes

If the brief changes after the project has begun (including design changes, layout changes, additional scenes, or reshoots), we may revise the fee accordingly.

6. Cancellation & Rescheduling

6.1 Client Cancellation

If you cancel:

  • The 50% deposit is non-refundable, regardless of when the cancellation occurs

  • If you cancel within 14 days of the scheduled shoot or project start date, you agree to pay 75% of the total project fee

6.2 Rescheduling

Rescheduling is possible subject to availability.
New dates must be agreed in writing.

6.3 Cancellation by Us

If we must cancel due to unforeseen circumstances, we will refund any fees paid for work not yet completed. We are not responsible for additional losses (e.g., travel or accommodation booked by you).

7. Revisions & Approvals

7.1 Included Revisions

Each project includes up to 3 rounds of revisions.

7.2 Additional Revisions

Any further revisions beyond the included 3 rounds will be billed at an agreed rate.

7.3 Client Approval

Once the final deliverables are approved, any further changes will be treated as new work and charged separately.

8. Intellectual Property & Licensing

8.1 Ownership

Unless otherwise agreed in writing, all intellectual property rights in the images, renders, and creative work remain the property of Simon Migaj Studio.

8.2 Licence to the Client

Upon full payment, you are granted a non-exclusive licence to use the final deliverables for the specific purposes agreed in your individual Project Agreement.

This licence:

  • Applies only to the final files delivered

  • Does not include raw files, 3D assets, or working files

  • Does not allow resale, sublicensing, or third-party distribution without written permission

8.3 Usage Outside the Original Scope

Any use outside the agreed licence — including extended commercial use, resale, or campaign distribution — requires written approval and may incur additional fees.

9. Portfolio Use

We may display the work we create for you in our:

  • Website portfolio

  • Social media

  • Marketing materials

  • Publications

  • Award submissions

Unless you specifically request otherwise in writing before the project begins.

10. Deliverables & File Storage

We will deliver the final files as agreed.
We do not guarantee long-term file storage, so please ensure you keep backups of all deliverables.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability for any claim is limited to the total amount you paid us for the project

  • We are not liable for any indirect, consequential, or financial losses, including loss of profits or data

  • We are not liable for issues caused by delays, inaccurate information provided by you, or third-party failures

Nothing in these Terms limits liability for fraud or anything that cannot be legally limited under UK law.

12. Force Majeure

We are not responsible for delays or failure to perform due to events beyond our reasonable control, including illness, extreme weather, equipment failure, or other unforeseen circumstances.
In such cases, we will work with you to reschedule.

13. Data Protection

We will process your personal data in accordance with our Privacy Policy, available at:

This covers how we collect, store, and use your data.

14. Termination

Either party may terminate the project in writing.
You must pay for:

  • All work completed up to the date of termination

  • Any third-party expenses already incurred

Licences already granted remain valid only upon full payment.

15. Dispute Resolution

We aim to resolve disputes amicably.
If a dispute cannot be resolved informally, it will be subject to the jurisdiction of the Courts of England & Wales.

16. Website Use

By using our website, you agree not to:

  • Copy or misuse content or imagery

  • Attempt to access restricted areas of the site

  • Use the site in any unlawful manner

We are not responsible for third-party links or external content.

17. Changes to These Terms

We may update these Terms from time to time.
